("we," "us," "Best Brilliance," or the "Site") and you ("User," "you") regarding your use of the website located at bestbrilliance.com (the "Site") and any services, products, and features provided therein (collectively, the "Services").

By accessing, browsing, or using this Site in any capacity—including but not limited to making purchases or registering an account—you expressly agree to be legally bound by these Terms. If you do not unconditionally agree to these Terms, you must immediately cease all use of this Site.

We may modify these Terms at any time without prior notice. Continued use of the Site after changes have been published constitutes explicit acceptance of the amended Terms.

 

 

2. User Registration and Account Responsibility

Eligibility: Use of this Site is strictly limited to individuals at least 21 years of age.

Registration: Users are required to provide accurate, current, and complete personal information during registration (name, email, phone number, and physical address).

Account Security: You must maintain confidentiality of your account password. You bear sole responsibility for all activities that occur through your account. Notify us immediately of unauthorized account usage at Unauthorized Use Notification.

We reserve the unconditional right to terminate or restrict your account at our discretion, including for violations of these Terms, suspected unlawful conduct, or at our sole convenience.

 

 

3. Purchase, Pricing, and Transactions

Offer and Acceptance: Items displayed are not contractual offers but invitations to purchase. A binding sales contract is created only upon our explicit acceptance communicated via email confirmation.

Information Accuracy: We strive for accuracy but expressly disclaim liability for typographical errors or inaccuracies in pricing, descriptions, availability, shipping terms, or other product-related information. Corrections or cancellations of erroneous orders may occur even after payment processing, in which case full refunds shall be promptly issued.

Merchandise Display: Product images and descriptions are illustrative; actual items may differ slightly due to digital displays, gemstone settings, resizing, and customizations. Users accept such minor variations without entitlement to discounts or refunds.

Diamond Documentation: Independent third-party certification accompanies certain diamonds. We disclaim any responsibility for accuracy or valuation discrepancies from such certificates.

Appraisal Certificates: Optional third-party appraisal certificates may be provided. We explicitly disclaim warranties regarding accuracy, completeness, or valuation differences contained within these certificates.

Pricing Policy: All prices are listed in USD and subject to change without notice. The final payable amount—including taxes, tariffs, insurance, shipping fees, customs duties, or other charges—will appear clearly during checkout.

Promotional and Sale Pricing: Prices during promotional periods apply strictly to purchases made within those specific promotional dates. We explicitly reserve the right to refuse any retroactive price adjustments, refunds, or compensation requests due to subsequent promotional pricing.

 

 

4. Order Cancellation Policy

You may request to cancel an order within 12 hours from placement. Any cancellation request after this 12-hour window is subject to a 20% restocking and repacking fee. Refunds (minus applicable fees) will be issued within 14 business days to the original payment method.

 

 

5. Delivery, Shipping, and Customs Clearance

Delivery Liability: We utilize trusted courier services (e.g., FedEx). However, liability for shipment delays, loss, or damage passes to you once products leave our premises.

Customs Responsibilities: You bear sole responsibility for customs clearance, duties, taxes, tariffs, and fees in your country. Failure to timely release shipments from customs will result in additional charges billed directly to your provided payment method.

By placing an order, buyers are committed to claiming their package upon delivery. Any package that remains unclaimed, refused, or returned due to the buyer's inability or unwillingness to accept delivery will not be eligible for a refund.

FedEx Hold for pickup – While we can request FedEx to hold your package for customer pickup, this service is provided by FedEx on a courtesy basis and is not guaranteed. We cannot ensure successful hold requests or accept responsibility for FedEx's handling of this request.

FedEx Identity Verification: FedEx may require a valid government-issued photo ID at delivery. You agree to bear all costs related to delivery refusal due to missing or invalid identification.

 

 

6. Return, Refund, and Exchange Policy

We proudly offer a 30-day Money Back Guarantee under strict conditions:

Products must be returned unworn, undamaged, unaltered, with original packaging, documentation (invoice, certificates), and tags intact.

Customized or special-order products are strictly non-returnable.

Loose diamonds returned without original grading certificates incur a $250 replacement fee.

Hassle-Free Return Instructions:

Contact Customer Service for your Return Authorization Number (RAN).

Use our provided prepaid shipping label and secure packaging methods (box, not envelope).

Returns must arrive within 30 days of initial delivery.


Note: You have *30 calendar days from the day of delivery* for your returned goods to arrive at our office. Items received beyond this 30-day period will not be eligible for a return or refund.

Refund Processing: Refunds, minus applicable fees, are processed within 14 business days after receipt and inspection.

 

 

7. Allergy and Sensitivity Disclaimer

We craft jewelry to stringent standards; however, some gold alloys may cause allergic reactions in certain individuals. We disclaim any liability and accept no returns based on allergic reactions. Exchanges for hypoallergenic alternatives (e.g., platinum) may be arranged at our discretion.

 

 

8. Non-Commercial Use and Intellectual Property Rights

This Site and all products, designs, images, trademarks, text, and proprietary information therein remain the exclusive intellectual property of Best Brilliance. Commercial reproduction, resale, modification, or distribution is expressly prohibited and may result in immediate legal action.

 

 

9. Coupon and Promotional Codes

Coupons (e.g., Registration Discounts of $100 off purchases $2,000 or more) must be applied at checkout. Coupons are non-transferable, non-cash redeemable, and cannot be combined unless explicitly stated. We reserve the right to modify or discontinue coupons at our sole discretion.

 

 

10. Liability Limitation, Indemnification, and Disclaimers

General Liability: Our liability for any claim related to your purchase or use of our Services will never exceed your actual payment to us for the product in question.

Disclaimers: Services and products are provided “as-is” and without warranty (express or implied). We explicitly disclaim all warranties, including merchantability or fitness for particular purposes.

Indemnification: You agree to indemnify, defend, and hold harmless Best Brilliance from all liabilities, claims, and expenses arising from your breach of these Terms or any third-party claims related to your use or misuse of products and services.

 

 

11. Privacy and Data Collection

We collect data to enhance our Site and advertising (e.g., using Microsoft Clarity). By using the Site, you agree to such data collection and processing per our Privacy Policy.

 

 

12. Governing Law, Jurisdiction, and Dispute Resolution

These Terms are governed exclusively by the laws of the State of New York. You expressly agree that disputes shall be resolved solely within the courts of New York County, NY, waiving all rights to jury trials or class actions.

 

 

13. Miscellaneous

These Terms comprise the complete agreement between you and Best Brilliance. No failure to enforce provisions herein waives future enforcement rights. If any provision is declared invalid or unenforceable, remaining terms remain fully valid and enforceable.
